2 - Governing law and Agreement
By accessing, using, browsing or booking on this site you agree that you have read, understood and agree to be bound by these terms of use and you agree to comply with all applicable laws, rules and regulations.
Any conference & events, travel, hotel booking or other services you purchase using this site will constitute a legal agreement between you and Sunnyway. Please note that in order to book conference & events, travel, hotel rooms or other services on this site you will be required to accept the relevantSunnyway's booking conditions. The booking conditions form the legal contract between you and Sunnyway and govern the terms on which conference & events, travel, hotel bookings or other services are offered and sold on this site. No contract shall be formed between you and Sunnyway until you have received confirmation that Sunnyway has accepted your booking.
Who can buy conference & events, travel arrangements or other services through Sunnyway?
This site and its services are only available to people, companies who, and parties that may, lawfully enter into and form contracts under Tunisian law. You must be aged 18 years or more to book a service from this site and there must be at least one adult (18 years or more) travelling on any one booking. Your booking is made direct with Sunnyway. This website is for use by companies and members of the public only to make direct bookings.
On any flights, your comfort and safety are always a priority. During maternity expectant mothers require a medical certificate stating the duration of the pregnancy and fitness to travel after 28 weeks, however travel is not permitted under any circumstances after 32 weeks. Current medical advice also recommends that mothers with new born babies do not fly within several days of the birth. Other airlines may differ so please ask for current information at time of booking.
This website has been designed for use within Tunisia and Europe. By accessing this website you are agreeing that the Courts of Tunisia will deal with any disputes which may arise between you and us, and that Tunisian law shall be the applicable law.
3 - Ownership and Use of material and information on our Website
This website displays brands, trademarks and registered trademarks which are registered in Tunisia and/or other countries. Other product and company names mentioned on this website are proprietary to their respective owners. You are not licensed to use any of the marks on our website unless written permission is granted, and you may not meta tag any of these marks.
Unless otherwise stated, we own (or are licensed to use) the intellectual property rights in the content and information in this website, including (without limitation) all text, sound, photographs, images, logos, videos, 360° maps, podcasts, blogs, customer reviews, graphics, design, underlying source code and software. Subject to the "Non-Commercial Use Only" section above, material and information, either whole or in part, from this website may not be reproduced, copied, republished, downloaded, posted, broadcast or transmitted in any form or medium without our and/or the appropriate owner's prior written permission.
4 - Variation of Terms of Use
These terms of use may be revised from time to time. If they are revised, we will post the revised version on this site. The revisions will be effective immediately. Please re-read these terms of use from time to time even if you have previously used this site. By using this site after we have changed the terms of use, you will be deemed to have accepted the changes. If, for any reason, you do not agree to abide by our terms of use, please do not use this site.
5 - Non-Commercial Use Only
You may only use this website for your own personal use (which will at all times be reasonable and not abusive) or for purposes legitimately connected with purchasing our products and services. You are not allowed to access, use or copy any material or information on this website for any commercial purpose or for any purposes which are unlawful. In particular, you are not allowed to copy (whether by printing off, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or use any material contained in this website except that you may print off any individual page for your own personal use.
6 - Booking and purchase
Booking and purchase conditions contain limitations and exclusions of liability to any person(s) who books and/or takes any of the services and/or conference & events and/or travel and/or accommodation arrangements advertised on this Site. Cancellation and amendment charges are payable if a booking or other purchase is cancelled or amended after it has been confirmed.
Cancellation: in accordance with the Tunisian law article 2 of the law decree number 73/13 of October 17 th 1973 a 10 working days cooling off period is granted prior to the reservation date. Refunds will be made within 10 working days from the cancellation date.
7 - Paying for your holiday
a) Booking online by credit card and/or cheque
We accept Visa and MasterCard. We do not accept Electron and American Express (Amex) or any other credit cards. Please note: there is a credit card transaction charge of 2% for Sunnyway payments made online. This charge is made to cover the administration charge that credit card companies make to us. Payment for services and arrangements booked online cannot be made using multiple credit cards. Payment options are as follows:
a/i) If you book more than 4 weeks before your holiday departure date you must pay a deposit of 30% of the total price. The balance is payable 4 weeks before your departure date by cheque to Sunnyway, 6 NEWHAVEN WALK - BOLTON - BL2 2UF.
a/ii) If you book less than 4 weeks before departure, you must pay the full price at the time of making the booking by credit card or cheque if there is time to clear it to meet the payment schedule mentioned above. (You need to allow 5 working days for clearance from the time we receive your cheque).
There is a 2% credit card fee for Sunnyway bookings made over the telephone. Payment can also be made by cheque if there is time to clear it to meet the payment schedule mentioned above. (You need to allow 5 working days for clearance from the time we receive your cheque).
8 - Your Holiday Contract
As soon as, but not before, we are credited with either your deposit or full payment your contract with Sunnyway takes effect. Once the contract is made, we are responsible to you to provide the holiday you have booked and you are responsible to us to pay for it subject to our advertised terms and conditions detailed elsewhere in this website. Please note it is important to check carefully the written confirmation of your booking when you receive it, or, if booking late, that all the details are exactly as requested at the time of booking. Our responsibility is to provide you with the services you have booked as described on our website and as confirmed to you.
9 - If You Make Changes
If you wish to change any of the details of your booking once it has been confirmed by us, we will do our best to accommodate these changes. It should be noted however, that we have no obligation to make any change other than to allow you or a member of your party who is prevented from travelling to cancel the booking. Any changes must be confirmed by email by the person who made the booking. These changes have not been noted unless you receive a receipt of email from us. Please note that a change of resort or flight will be treated as a cancellation and re-booking. Please note too that we cannot accept any changes communicated to us by any other person on the booking. If an amendment to the holiday is possible, a charge will be made as outlined in the scale below:

In addition to the charges shown above we may also have to charge you any additional costs involved. Scheduled airlines and certain charter airlines normally regard name changes and date changes as a cancellation and re-booking so any name change at any time may incur a 100% cancellation charge.
For accommodation and transfers only:
If you want to change any details of your booking concerning accommodation or names in your party, we will endeavour to help. If we can make the change(s) you request we will charge an ‘admin fee’ as per the table below for each detail of the booking that we accept to change on your behalf without a cancellation fee. These admin fee charges are not usually covered by your insurance.

Please note: Some types of accommodation are priced according to the number of people staying in a room. If someone in your party cancels, the booking cost will be recalculated according to the revised number of people sharing a room.
10 - If You Cancel Your Holiday
In certain cases we incur costs for your holiday from the time we confirm your booking. Consequently there will be a cancellation charge, and the later the cancellation, the higher that charge will be. If you wish to cancel your holiday, the cancellation must be in writing and authorised by the person in whose name the booking is made. These written instructions should be e-mailed immediately to info@sunnywaytravel.com. If you do not receive an ‘acknowledgement of receipt’ e-mail from us, you must email again as notice of cancellation is not accepted unless we have confirmed receipt to you. Alternatively letters should be sent by recorded delivery to Sunnyway, 6 NEWHAVEN WALK - BOLTON - BL2 2UF. Cancellation takes effect from the date we receive your letter. Cancellation charges will be calculated as set out below and will be notified to you within 2 weeks of cancellation (please remember these charges also apply if you fail to make payment on time and, as a result, we cancel your holiday) :

Please note that if you cancel your holiday for a reason covered by your insurance policy you will be able to reclaim your cancellation charges subject to any excess payable. Cancellation charges exclude the insurance premium which is not refundable. Christmas / Easter holidays and holidays involving scheduled flights may involve higher cancellation charges and these will be advised at the time of the proposed cancellation.
11 - If We Cancel or Make Changes to Your Holiday
Our website is prepared many months before the holiday season commences so changes may be made to the information contained in it. If any changes occur before you book, we will tell you at the time of booking. It may be necessary, even after we have confirmed your booking, to amend your holiday arrangements. Most changes will be minor and will have little effect on your holiday. If possible, we will inform you as soon as possible before your departure but will have no other liability to you.
Occasionally we may have to make an important change (including cancellation) to your holiday after confirmation. Important changes are as follows:
* Change of UK departure airport (other than Gatwick, Heathrow, Stansted or Luton which are all classified as a London airport),
* Change of your time of departure from the UK by more than 12 hours,
* Change of resort area,
* Change of accommodation where the new accommodation is of a lower category (where applicable).
If we have to make such a change we will notify you as soon as possible and you may then :
a) Accept the change and the contract between us will be adjusted to incorporate the change.
b) Purchase another available holiday from us at its advertised price.
c) Withdraw from the booking completely in which case we will refund all monies paid to us.
If you accept a major change, or if we cancel your holiday and if you choose option “a” or “b”, we will compensate you according to scale A below, in addition to any refund. If you choose option "c", we will compensate you according scale B. Compensation is only payable in cases where we cancel or make an important change after the balance due date unless the reason for the cancellation or change is caused by ‘force majeure’. This means that we will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions.

12 - Our Liability to You
We accept full liability for the proper performance of our obligations under our agreement with you for the provision of your holiday. If you or any member of your party suffers damage as a result of our failure to perform, or our improper performance of our agreement with you for the provision of your holiday, we accept liability except in the following circumstances:
a) if the failure or improper performance is your fault or the fault of any member of your party.
b) any unusual and unforeseeable circumstance beyond our control, the consequences of which could not have been avoided even if all due care had been exercised
13 - FlightsThe flights we offer are scheduled to be operated by British Airways, Tunisiair, First Choice, Thomsonfly, Thomas Cook, MyTravel Airlines, Nouvelair, Karthago, Excel Airways. However, we reserve the right to change airlines and aircraft type without notice. Such changes will not be regarded as “important” and you will not be entitled to cancel your holiday without paying the appropriate cancellation charge (see “Paragraph 9”). Although the flight times on our website are correct at the time of publication, they are subject to alteration by, amongst other things, the various UK and overseas airport scheduling committees. You may be entitled to cancel your holiday booking without penalty or to receive compensation when the change to your flight times is 12 hours or more (see Paragraph10). All bookings are accepted subject to the Civil Aviation Authorities granting the relevant licences. You are reminded that aircraft captains have absolute authority over the aircraft and its passengers while boarding or in flight. The captain or other authorised representatives or the airline can refuse to carry anyone if they are unruly or deemed unfit to travel or are seen as a danger to the flight or any other passengers. This decision is final and not open to appeal. If you are refused carriage in these circumstances, your holiday will terminate immediately as will the contract between you and Sunnyway and we will have no further responsibility or liability to you.
14 - Indemnity
When you book a holiday you accept responsibility for the proper conduct of yourself and, if travelling with others, your party whilst on holiday. We reserve the right to cancel any holiday at any time. We also reserve the right to cancel or terminate your holiday and/or that of any member of your party due to misconduct. If your actions or those of any member of your party cause damage to the accommodation in which you are staying or cause delay to any flight or other means of transportation, you agree to fully indemnify us against any claim (including legal costs) made against us by or on behalf of the owners of such accommodation or other operator of such flight or other means of transportation.
15 - Travel Insurance
Travel insurance is a vital part of your trip. No-one wants anything to go wrong on holiday, but if it does, insurance can take away at least some of the pain and hassle. If you have your passport stolen on the beach, drop your camera in a club or have to see a doctor about a sunburn or dodgy tummy, insurance is often the only way you can avoid being out of pocket. Here are a few pointers.
- Always buy insurance before you travel. It can be very difficult or impossible to arrange once your trip has started. Buying insurance that covers cancellation when you buy your holiday will give you peace of mind should you have to cancel unexpectedly.
- Always provide your insurer with the correct information regarding ages, places and pre-existing medical conditions. Not disclosing these could lead to your policy being void.
- Check the small print of your insurance policy. The cheapest insurance may not offer you enough cover for your needs. It may also exclude certain activities and items. Check also for the amount of the policy excess - the amount you have to contribute to the cost of replacing the stolen item.
- Remember to take your travel insurance documents with you on your trip. It is worth noting down the emergency contact numbers and your policy reference numbers and carrying them with you at all times.
- Don't keep your travel insurance documents with your wallet, camera or anything else that is likely to get stolen.
Always ensure your insurance covers you for any activities you may be undertaking on holiday. Most general policies exclude sports such as scuba diving or ski-ing, so make sure you buy the correct policy for your needs.

16 - Passports/Visas/Vaccinations/Foreign Office Advice
All members of the travelling party must each possess a valid passport and visa (if applicable). Be certain to apply in time. You must also ensure you have had all applicable vaccinations before you travel. For up to date information please consult your local doctor. Alternatively check out the Extra Travel Information section on this site. If you fail to obtain the relevant documentation and vaccinations before you travel you will be solely responsible for any costs, loss or damage which you or incur as a result of that failure. Sunnyway shall not be liable for any such.

Access to this site is free. However, you access and use it entirely at your own risk. Except as stated in these terms of use we make no representations or warranties in respect of the site, its contents or performance and all conditions and warranties that might otherwise be implied by statute or at common law are excluded to the fullest extent permitted by law. In particular, we do not accept responsibility for the material supplied by independent contributors. The amount of material we receive makes it impractical for us always to vet it before it goes on the site or to check its accuracy. Instead we require and expect contributors to ensure that the material they contribute is legal and accurate.
